They are in Canada.
If the vehicle came equipped with the 3rd light it has to function.
I have seen a few, well one the other day where Steve used a round red
light and put it in the center of his spare tire rack so when the big
33" tire is on, he had a 3rd light.

I recently asked a cop here in NJ that very same question. He said it
became a Federal Motor Vehicle Safety Standard in (I think) 1986. He
told me that no cop is going to pull you over if it's missing the third
brake light, but they will pull you over if you have it and it doesn't
work. Also, here in NJ they will flunk you at inspection for not having
it on there. Bastards.
